Agreement to Terms
Welcome to KAVION Productions (“KAVION”, “Company”, “we”, “us”, or “our”), operating via https://www.kavionproductions.com. These Terms & Conditions of Service (“Terms”) constitute a legally binding agreement between you (“Client”, “User”, “you”) and KAVION Productions.
By accessing our website, testing your brand on our Free AI Visibility Scanner, purchasing our Full AI Visibility Audit (₹15,000), booking a Strategy Consultation (₹5,000), or engaging our Monthly Retainer Packages (₹75,000 – ₹1,80,000+/mo), you acknowledge that you have read, understood, and agree to be bound by all of these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of our website and services.
1. Scope & Description of Services
KAVION provides specialized digital authority engineering, Answer Engine Optimization (AEO), Generative Engine Optimization (GEO), and content production designed to maximize client visibility on modern artificial intelligence platforms:
A. Free AI Visibility Checker
An automated diagnostic tool providing instant category evaluations by probing simulated conversational queries across ChatGPT, Google Gemini, and Claude. Provided free of charge for legitimate preliminary business assessment.
B. Full AI Visibility Audit (₹15,000)
A bespoke, multi-page diagnostic dossier including AI Visibility Score (0-100), competitor recommendation matrix, content gap analysis, priority action roadmap, and a 60-minute recorded strategy consultation with KAVION’s founder.
C. 1-on-1 Strategy Consultation (₹5,000)
A focused 30-minute private video diagnostic with a senior strategist to review brand discoverability bottlenecks, positioning gaps, and actionable fixes.
D. Monthly Retainer Packages (₹75k – ₹180k+/mo)
Ongoing 5-tier execution (Discover, Authorize, Amplify, Dominate, and Custom Enterprise) encompassing 8 to 30 monthly AI-optimized long-form articles, LinkedIn/video assets, schema entity injection, third-party citation footprints, and monthly score tracking.
2. AI Platforms Disclaimer & Algorithmic Independence
KAVION employs proprietary, industry-leading semantic engineering, entity architecture, and citation frameworks. However, you acknowledge and agree to the following operational parameters:
Third-party AI platforms—including OpenAI (ChatGPT), Google (Gemini), Anthropic (Claude), Perplexity AI, and Microsoft Copilot—are autonomous software systems operated independently by their respective parent entities. These companies update foundational model weights, retrieval-augmented generation (RAG) pipelines, and safety heuristics continuously and without prior notice.
While KAVION structures and syndicates your content to maximize LLM indexing, extraction, and citation trust, KAVION does not own third-party AI platforms and cannot guarantee unilateral, permanent, or specific rank placements. Generative outputs are inherently dynamic and query-dependent.
3. Fees, Payment Terms & Invoicing
- Currency & Pricing: All service fees are quoted in Indian Rupees (INR ₹) unless explicitly stated otherwise in a custom commercial agreement. Prices are subject to applicable Goods and Services Tax (GST) under Indian statutory law.
- Payment Processing via Razorpay: All digital transactions are processed securely through our Reserve Bank of India (RBI)-authorized payment partner, **Razorpay Software Private Limited**. KAVION supports UPI, Net Banking, Credit/Debit Cards, and corporate payment methods.
- Upfront Billing: One-time Audits (₹15,000) and Strategy Sessions (₹5,000) must be paid 100% in advance prior to diagnostic initiation or calendar slot reservation.
- Retainer Invoicing & Due Dates: Monthly retainers are billed on a recurring advance basis. Invoices must be settled within five (5) business days of issuance to avoid work interruption.
4. Service Fulfillment & Delivery Schedules
Delivered digitally via secure PDF and interactive link within 5 to 7 business days following confirmed receipt of your completed Brand Onboarding Form.
Month 1 editorial calendars are submitted for Client approval within seven (7) business days of retainer kickoff. Production occurs systematically on weekly cycles.
5. Cancellation, Rescheduling & Refund Policy
A. AI Visibility Audits (Strict Non-Refundable Policy)
Because extensive proprietary research, cloud compute queries, competitive scraping, and dedicated senior strategist hours are deployed immediately upon checkout, all sales for the AI Visibility Audit (₹15,000) are strictly final and non-refundable once payment is processed.
B. Strategy Consultations Rescheduling
Clients may reschedule a booked Strategy Consultation at least twenty-four (24) hours prior to the scheduled call time by emailing hello@kavionproductions.com or messaging our official WhatsApp support. Missed appointments (“no-shows”) without 24-hour advance notice are non-refundable and forfeit the slot.
C. Monthly Retainer Minimum Commitment & Termination
Because AI entity authority and citation footprints compound over multi-month cycles, all retainer packages carry a mandatory initial commitment period of three (3) consecutive months. Following the initial 3-month period, retainers transition to month-to-month and may be terminated by either party with thirty (30) days advance written notice.
6. Intellectual Property & Deliverables Ownership
Client Deliverable Ownership: Upon full payment of all associated service fees, the Client holds exclusive, perpetual ownership of all bespoke written content, published articles, social media assets, and custom website schema code produced specifically for the Client under the engagement.
KAVION Proprietary IP: KAVION retains all right, title, and interest in its underlying diagnostic software, Free AI Visibility Scanner, proprietary scoring algorithms, prompt templates, research frameworks, website design, trademarks, and branding. Nothing in these Terms transfers ownership of KAVION’s core proprietary technology to the Client.
7. Website Acceptable Use & Security Rules
You agree not to engage in any prohibited activities when using our website or diagnostic tools:
- Do not deploy automated bots, spiders, crawlers, or scrapers against our Free Scanner or API endpoints.
- Do not attempt prompt injection, SQL injection, cross-site scripting (XSS), or DDoS attacks against our servers.
- Do not submit fraudulent or malicious business domains that you do not own or represent.
KAVION enforces automated rate-limiting, IP shielding, and CAPTCHA validation. Violators will be permanently locked out and reported to relevant cybersecurity authorities.
8. Limitation of Liability & Indemnity
To the maximum extent permitted by applicable law, in no event shall KAVION Productions, its directors, employees, affiliates, or agents be liable for any indirect, incidental, special, consequential, or punitive damages—including lost profits, business interruption, loss of data, or commercial reputational injury—arising out of your use of our services or external AI platform behavior.
Liability Cap: In all circumstances, KAVION’s aggregate liability arising under or related to these Terms shall be strictly capped at the total amount actually paid by you to KAVION in the three (3) months immediately preceding the event giving rise to the claim.
Client Indemnification: You agree to defend, indemnify, and hold harmless KAVION Productions from any third-party claims, damages, or liabilities arising from any inaccurate, misleading, or infringing business information or credentials provided by you for publication.
9. Governing Law & Jurisdiction
These Terms, and any disputes arising out of or related to our services, shall be governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict of law principles.
In the event of any controversy or claim, the parties agree to first attempt resolution through good-faith executive negotiation for a minimum of thirty (30) calendar days. Should negotiation fail, the dispute shall be subject to the exclusive jurisdiction of the competent courts located in Kolkata, West Bengal, India.
